Gregory Allen wants to sue the city of Arcata, California, because he says that they intentionally tried to sabotage his 4/20 celebrations. Allen claims that the police and city officials engaged in a secret multi-year plan to try and squash cannabis celebrations at Redwood Park in the city.
Allen claims that the police did things like spread fish-scented fertilizer around the park, in an effort to try and discourage people from coming out and attending any cannabis celebration.
The 9th Circuit Court of Appeals just ruled this week that Allen is allowed to proceed with his lawsuit against the city; he's been trying to sue them since 2014. He firmly believes that city officials intentionally conspired with law enforcement to infringe upon the annual celebration.
If you aren't free to express yourself, by engaging in peaceful disobedience in the public park, then you are living in a police state says Allen's lawyer.
Getting to choose what we put into our own bodies should be an extension of our natural rights. Cannabis and hemp have a long history in the United States and it's a violation to the people's liberty to punish them for trying to engage in such an act.
Is it really a wise allocation of time and resources for the state to initiate violence against people who are peacefully consuming an herb? The people not only in the U.S. but around the world are growing tired of the drug war farce and it's past the time for it to be put to an end.
Allen has tried to argue that the actions of city officials and law enforcement in this matter violated his First Amendment rights.
City officials don't seem too worried about the matter, they've indicated that they believe the suit will ultimately be dismissed; despite the recent ruling from the 9th Circuit Court of Appeals.
