What is a Pre-trial Conference? Generally, this is a very low-stress hearing. For the most part, you should be in and out of there in just a few minutes. If that's not the case, there is something else going on you should know about. It's always a good idea to have an experienced attorney at the Pre-trial Conference.
Although it may be referred to by many different names, such as a Case Management Conference or Status Hearing it's still a pre-trial conference. What the judge wants to know at the Pre-trial Conference is, are you going to trial or are you going to resolve the matter without going to trial? There will most likely be several scheduled Pre-trial Conferences. What most likely will happen at the first Pre-trial Conference is your attorney will let the judge know that he needs more time that he is not ready to make that decision yet. The judge will then schedule another Pre-trial Conference for another date, usually about 30 days down the road. If there are too many rescheduled dates, the judge will most likely let you know that this case has been delayed too long and go ahead and schedule a trial date. But usually, you will be granted at least three continuances.
