LAWS OF THE FAMILY CODE THAT GIVE FREEDOM TO CPS' OUTRAGE

First of all, I must clarify misunderstanding with Hive account@familyprotection community, which I appreciate and respect very much, as well as its creators and promoters Hive account@markwhittam and Hive account@canadian-coconut.

I have recently seen a post of Hive account@markwhittam, where he is angry with all authors who write for the community but don't donate or do it not enough. I was absolutely agree with this post! I do notice unjustice in this question too, and I do understand Hive account@markwhittam and his negative emotions and anger about it because Hive account@familyprotection is like his one more "child", and he takes all unjustice in it close to his heart.

When I have read the post, I have realized that though I didn't have any idea to cheat the community, but unconsciously I broke the rules too because I didn't donate after every post.

The reason is just in misunderstanding the main rules of cooperation with Hive account@familyprotection. I donated not at once just because I wanted to colelct more SBD for transferring. It seemed to me it would be better to donate not  3 SBD for 3 times, for example, but 10 SBD for 1 time. But I didn't think that it would make problems for people who kept records and analyzed the amount of donation for every author. But it's important and necessary to do to avoid fraud.

The post which explained the enough amount of donations and its frequency appeared not at once after the start of Familyprotection. Now it has become much better to understand what to do and when. Thank you!

SO I'm really sorry for my mistake and thanks for explanation! You're absolutely right! Now if I make posts for the community I will donate at once and not less than 25%.

Nowadays CPS have become real horror for many families. Parents are afraid they will come and just take kids away.  Representatives of the law explain that it's impossile because they must act accoring to the Constitution and the Family Code, and they really do it but the problem is that the law has so many "holes"!

In general, the law assumes only one option for taking away a child from the family, not by a court decision. 

This is the 77th article of the Family Code, which describes the procedure for "taking away a child who has an immediate threat to his life or health."But there is NO information what is considered to be  "an immediate threat to life and health." 

Article 77. Taking away a child in the case of a direct threat to the life  or his or her health. The guardianship authority has the right to take the child from the parents (one of them) or from other persons in the care of whom he is in at the moment immediately.

This decision is entirely left to the discretion of the authorities. It's their own choice where to see a threat to kid's health! 

But the main thing is, if CPS decide to take kids away they must keep 3 main conditions:

•  To draw up an act of removal - signed by the head of the municipality
• Within three days, notify the prosecutor's office
•  And in a seven-day period to sue for deprivation or restriction of the rights of parents. 

If CPS workers doubt if there is an immediate threat or not, but they have some fears, they look for options how to take the child away without following this law article!

• Calling the police

For example, the police are involved, and it draws up an act of homelessness - that is, about finding a street child. Although in fact the child could be found at the parents' house, with the same parents standing side by side.  But the law on the prevention of homelessness allows the Ministry of Internal Affairs to interpret the concept of it very widely. 

Policemen can say that parents have not noticed any problems in the behavior and health of the child or do not pay enough attention to him - that means they do not control his behavior. So they can draw up an act of homelessness and take the child away. And there are so many cases of it!

• to threaten parents that they will lose a kid forever and make them sign an act of placing the child in a shelter or an orphanage

They promise that when parents decide all problems, they will be able to take kids back to home at any time BUT in fact it's very hard to do it! Of course, it's a fatal mistake and naivety of parents but in this situation many of them just lose a possibility of thinking and analyzing!

That is the main problem that makes all these cases of CPS' unjustice and terror happen. The parents should know their right, the law and the ways of protecting theit kids and families.

Knowledge is power. If you know your rights, you're under protection. If you know what can happen and how it has happened to another families, you'll be ready to face this problem and to solve it better and easier.

Personally I have started to study CPS' activity and cases of breaking families and kids' lives only when I have discovered it really happens every day!

It's not far and somewhere, it's here and close! And that's why Hive account@familyprotection activity and knowledge it gives to parents are SO essential and urgent!
