The Trudeau administration's employment of the Emergencies Act is illogical and detrimental to the Constitutional Charter as the Freedom Convoy did not pose a threat to Canada's security. In a recent hearing, federal judge Richard Mosely made this ruling, which is a win for the demonstrators who organized against the government's COVID restrictions that were put in place between
January and February of last year. Hundreds of truck drivers and regular people actually descended upon several Canadian cities, most notably Ottawa, at the end of January 2022 to demonstrate against the truck driver vaccination mandate and, more broadly, against the liberticidal policies that defined the Covid era.
A massive mobilization that reverberated throughout Australia and Europe led to the police using excessive force in response, and ultimately the Trudeau administration turned to the Emergencies Act, a 1988 law that replaced the War Measures Act but had never been used until 2022. greater importantly, the order empowered the police to seize greater authority, forbade public protests, and, worst of all, permitted the freezing of demonstrators' bank accounts.
The judge ruled that the government could have used alternative means to quell the protests and could have just restricted the most extreme measures to Ontario, the area where the demonstrations had been most intense. But in doing so, the government violated the Canadian Charter of Rights' guarantees of freedom of speech, freedom of religion, and the right to be free from arbitrary detentions. It's interesting to note that the federal court did not harshly denounce the Trudeau administration's decision.
In fact, the judge acknowledges in his rulings that he was leaning toward thinking that the decision to invoke the EA was reasonable, that he had some sympathy for the ruling class at the time, and that he only changed his opinion after hearing the arguments put forth by the protestors' attorneys.
