For democracy to be effective, there needs to be order and for a country to be in order, there needs to be rules and regulations. But what’s that constitutional rule in your country that makes you wonder who was even behind it in the first place because it achieves nothing.
Laws are naturally made to keep people and the society in check, there are several laws that has to do with people not partaking in certain activities so that there will be peace and harmony in the country.
So far so good, people have tried to abide by these laws despite the fact that the government has not implemented enough strategies that can help people. Different laws has to do with different aspect such as rape, child abuse, defamation, theft, rigging, electoral malpractices, cheating, divorce, violence and so on.
The issues I have with these laws is that security agencies have lapsed in their duties, that actions are not carried out on perpetrators immediately. The law is only used on people who are vulnerable because in our present day, as the law is only faithful towards those who can afford to pay for fast tracking.
During a research, I found out about an immunity clause that operates in the Nigerian constitutional provision in the section 308 of the 1999 constitution.
The constitution states that:
Section 308 of the Constitution of the Federal Republic of Nigeria
(1) Notwithstanding anything to the contrary in this Constitution, but subject to subsection (2) of this section -
(a) no civil or criminal proceedings shall be instituted or continued against a person to whom this section applies during his period of office;
(b) a person to whom this section applies shall not be arrested or imprisoned during that period either in pursuance of the process of any court or otherwise; and
(c) no process of any court requiring or compelling the appearance of a person to whom this section applies, shall be applied for or issued.
As we can see from the constitution above, it sot of shows that our leaders can do whatever they like when they are in power and it brings about an abuse of power. No wonder they do a lot of damages to our society and they are not held accountable for it.
It allows corruption to persist among these people, and brings about inequality amongst the citizens of the country.
In conclusion, a law that allows some certain people to get away with their wrong doing is not even supposed to to exist at all. All leaders are supposed to be accountable for their actions regardless of their positions.
