Cops Can’t Arrest You For Smoking Marijuana On Sidewalks, NYPD Says In Post-Legalization Memo

There are exceptions to the rule if a person driving a car is observed to be impaired and “there is probable cause to believe that the vehicle contains evidence of the impairing marihuana (e.g. smell of burnt marihuana or admission of having smoked recently).” Enforcement can also be taken if a person is seen consuming cannabis while driving, regardless of whether they don’t show signs of impairment.
Possession of marijuana by people under 21 is also unlawful, but “under the current state of the law, there is no mechanism for the NYPD to take enforcement action against a person under 21 who possesses 3 ounces or less.”
“In the future, the NYPD may have the ability to issue a civil summons for such violations,” the memo says. “Until that time, possession of 3 ounces or less by a person under 21 cannot be the basis of an approach, stop, summons, juvenile report or arrest. Possession by individuals under 21 of more than 3 ounces is enforceable.”
Another significant policy change concerns people on parole, who are now “permitted to use marihuana unless the terms of their parole specifically prohibit it.”

Colorado Benefit Concert To Honor The Memory Of Charlotte Figi
The April 7 livestreamed concert, featuring performances by acts including The Avett Brothers and Jason Mraz and appearances by Colorado Gov. Jared Polis and CNN’s Dr. Sanjay Gupta, has been dubbed Rock the RoC. The name of the event is a reference to the Realm of Caring (RoC), a nonprofit dedicated to supporting research into cannabinoids and helping patients who need them gain access to lifesaving medications.
Charlotte gained global notoriety after being featured on “Weed,” a 2013 CNN documentary by Gupta, the network’s chief medical correspondent. She had a rare form of epilepsy known as Dravet syndrome that caused dozens or even hundreds of seizures per day. After traditional treatments for the disease were unsuccessful, Charlotte’s mother Paige Figi decided to try medicinal cannabis with tremendous results, which were documented by Gupta. Sadly, Charlotte died last year at the age of 13.
“On April 7, 2020, Charlotte Figi passed away, leaving the world with her life-changing story of overcoming adversity through courage and grace, and impacting the lives of millions along the way whose wellness and dignity were in part made possible by Charlotte and the Figi family’s efforts,” Polis said in a statement to High Times. “This year on April 7, we celebrate Charlotte Figi day to honor her legacy and the battle that so many continue to fight.”

Recycled HEMP Act proposes measuring THC at producer level
The re-introduction of HEMP Act comes after U.S. Department of Agriculture hemp rules took effect March 22. Those rules set a threshold for “negligent” THC violations at 1.0% THC, meaning hemp producers whose crops go over the federal 0.3% limit but do not exceed 1.0% THC will not be considered in #violation of the law. However farmers must destroy those #crops.
Paul’s proposal would ease up on enforcement and most likely encourage research of hemp varieties that express THC levels between 0.3% and 1.0%. Higher #thc levels would be positive for the #cbd sector as CBD rises in industrial hemp in proportion to THC.
The HEMP Act would also expand the type of documentation valid for individuals transporting #hemp shipments, among other changes.
