In the hearing, the NGO's wife, Male Welfare Trust, was opposed to considering the rape as a crime.
The court jointly petitioned an NGO named RIT and the All India Democratic Women Association challenged section 375 of India's Penal Code. It is said in this section that rape of a person's sexual partner is not considered rape.
In response to the petition, the male welfare trust said in the hearing that despite the marriage, there are enough laws to protect women from sexual violence, so that the change of the party is unacceptable.
