The understanding of the Gampong Beuringen Community on the Function of Wakaf Land Certificate

To know well and comprehensively about understanding of Gampong Beuringen community about the function of wakaf land certificate, the authors conducted interviews with the informants as research samples. The author interview results are as follows:

According to Tgk. M. Umar is a religious figure and is the Imum Chik Masjid Madinatul Abrar Gampong Beuringen Meurah Mulia District, according to him for the modern era as it is today, the existence of the land certificate of waqf is very important and the function of wakaf land is according to him is to guarantee the land is not problematic and become a dispute in the future, especially with the heirs of the person who has donated the land, he added with the certificate will be a strong guarantee in front of the law if at any time there is a dispute with the land.

According to Tgk. Abdurrahman who is the Imam of Gampong Beuringen, in every legal act such as buying and selling, pledge, rent and including wakaf there must be correspondence as authentic evidence in the future. This is also true in the practice of land representation, where much is happening now as we read in the mass media of heirs sue or retake land which has been represented for economic reasons ie the price of the land is very expensive, this is where according to him the importance of the function of land certificate of waqf, so that the benefits of the land that has been reproduced can be eternal for the people and people who have been able to do so without being able to be contested by others in the future.

Unlike the case with the understanding of Hj. Kamariah, one of the residents of Beampung Village of Meurah Mulia District who donated a plot of land for wakaf assets of Masjid Madinatul Abrar Gampong Beuringen, according to him wakaf is a worship and a form of gratitude to God who must be accompanied by keihklasan expecting Allah SWT exclusively and far from the element of showing off other people. The most important thing in the waqf is the fulfillment of the terms and rukun wakaf itself, while the administrative problems such as the handling of correspondence and certificates do not determine the validity of the waqf, even he handed over to the mosque board to make a certificate or not from the land he wakafkan. According to him the function of wakaf land certificate if there is a dispute need not be feared if the heirs of people who understand religion, they will not sue the land that has been represented by their parents.

One of the other wakif writers interviewed namely Mr. Ismail, has a different understanding with Hj. Kamariah. According to Mr. Ismail, wakaf is a worship associated with property so it is important that there is a correspondence as proof. According to him the function of wakaf land certificate is as legitimate evidence of wakaf that has been done that is useful for the person who wakafkan and the recipient of the waqf itself. With the certificate of wakaf land will add confidence to the wakif itself that the waqf that is done in addition to already legally syara 'also has been in accordance with the applicable regulations. According to Mr. Ismail's confession, the paddy field that he has donated to the Madinatul Abrar Mosque is in charge of his certificate. For the handling of the land certificate of wakaf is fully he submitted to the mosque administrator as nazhir from the wakaf land.
From the results of interviews with the community that the authors choose as research informants, only H. Hasan as wakif (the party who menghakafkan land) who claimed not understand the administration perwakafan especially related to his understanding of the function of wakaf land certificate so the authors did not ask his understanding of the function of land certificate of waqf , let alone his condition is very elderly and sickly.

Pemahaman Masyarakat Gampong Beuringen Terhadap Fungsi Sertifikat Tanah Wakaf

Untuk mengetahui dengan baik dan menyeluruh tentang pemahaman masyarakat Gampong Beuringen terhadap fungsi sertifikat tanah wakaf, penulis melakukan wawancara dengan para informan sebagai sampel penelitian. Adapun hasil wawancara penulis adalah sebagai berikut:

Menurut Tgk. M. Umar seorang tokoh agama dan merupakan Imum Chik Masjid Madinatul Abrar Gampong Beuringen Kecamatan Meurah Mulia, menurut beliau untuk zaman yang sudah modern seperti sekarang ini, keberadaan sertifikat tanah wakaf sangatlah penting dan fungsi sertikat tanah wakaf menurut beliau adalah untuk menjamin tanah tersebut tidak bermasalah dan menjadi sengketa dikemudian hari terutama dengan ahli waris dari orang yang telah mewakafkan tanah tersebut, beliau menambahkan dengan adanya sertifikat akan menjadi jaminan yang kuat di depan hukum bila sewaktu-waktu terjadi sengketa dengan tanah tersebut.

Menurut Tgk. Abdurrahman yang merupakan Imam Gampong Beuringen, dalam setiap perbuatan hukum seperti jual beli, gadai, sewa dan termasuk wakaf harus ada surat menyurat sebagai bukti otentik dikemudian hari. Hal tersebut juga berlaku dalam praktik perwakafan tanah, dimana banyak terjadi sekarang sebagaimana kita baca di media massa ahli waris menggugat atau menguasai kembali tanah yang telah diwakafkan karena alasan ekonomi yaitu harga tanah tersebut sudah sangat mahal, disinilah menurut beliau pentingnya fungsi sertifikat tanah wakaf, sehingga manfaat dari tanah yang telah diwakafkan dapat abadi untuk umat dan orang yang telah mewakafkannya tanpa bisa diganggu gugat oleh orang lain dikemudian hari.

Berbeda halnya dengan pemahaman Hj. Kamariah, salah seorang warga Gampong Beuringen Kecamatan Meurah Mulia yang mewakafkan sepetak tanah sawahnya untuk aset wakaf Masjid Madinatul Abrar Gampong Beuringen, menurut beliau wakaf merupakan ibadah dan bentuk rasa syukur kepada Allah yang harus disertai keihklasan mengharap ridha Allah SWT semata dan jauh dari unsur pamer kepada orang lain. Hal yang paling penting dalam wakaf adalah terpenuhinya syarat dan rukun wakaf itu sendiri, sedangkan permasalahan administrasi seperti pengurusan surat menyurat dan sertifikat tidak menentukan keabsahan wakaf, bahkan beliau menyerahkan kepada pihak pengurus Masjid untuk membuat sertifikat atau tidak dari tanah yang beliau wakafkan. Menurut beliau fungsi sertifikat tanah wakaf jika terjadi sengketa tidak perlu dikhawatirkan bila para ahli waris orang yang mengerti agama, mereka tidak akan menggugat tanah yang telah diwakafkan orang tuanya.

Salah satu wakif lain yang penulis wawancarai yakni Bapak Ismail, mempunyai pemahaman yang berbeda dengan Hj. Kamariah. Menurut Bapak Ismail, wakaf adalah ibadah yang terkait dengan harta benda sehingga penting adanya surat menyurat sebagai buktinya. Menurut beliau fungsi sertifikat tanah wakaf adalah sebagai bukti sah dari wakaf yang telah dilakukan yang berguna bagi orang yang mewakafkan dan penerima wakaf itu sendiri. Dengan adanya sertifikat tanah wakaf akan menambah keyakinan bagi wakif sendiri bahwa wakaf yang dilakukan selain telah sah secara hukum syara’ juga telah sesuai dengan peraturan yang berlaku. Menurut pengakuan Bapak Ismail, tanah sawah yang telah beliau wakafkan untuk Masjid Madinatul Abrar dalam pengurusan sertifikatnya. Untuk pengurusan sertifikat tanah wakaf tersebut sepenuhnya beliau serahkan kepada pengurus Masjid selaku nazhir dari tanah wakaf tersebut.

Dari hasil wawancara dengan masyarakat yang penulis pilih sebagai informan penelitian, hanya H. Hasan selaku wakif (pihak yang mewakafkan tanahnya) yang mengaku tidak memahami administrasi perwakafan khususnya terkait pemahaman beliau tentang fungsi sertifikat tanah wakaf sehingga penulis tidak menanyakan pemahaman beliau terhadap fungsi sertifikat tanah wakaf, apalagi kondisi beliau sudah sangat uzur dan sakit-sakitan.
