A lawfirm announced a great win for a baby girl suffering from sever reactions to the MMR vaccine. The child will have to suffer for a lifetime, but will receive $101 million which will be paid out throughout her lifetime.
The lawfirm, Maglio Christopher & Toale, P.A., announced the settlement in July:
O.R. was a one-year-old healthy baby girl who was already walking and climbing. On February 13, 2013, she received vaccinations for Measles Mumps Rubella (MMR), Hepatitis A, Haemophilus Influenzae type B (Hib), Prevnar (pneumonia), and Varicella (chickenpox).That evening, the mother noticed baby O.R. was irritable and feverish.
After a call to the pediatrician, the doctor advised Mom to give her Tylenol and Benadryl. The fever continued for several days and on the evening before the baby’s scheduled pediatrician visit, O.R. began having severe seizures.
She was rushed to the emergency room. Baby O.R. went into cardiac and respiratory arrest and doctors placed her on a ventilator.
The seizures and cardiac arrest left O.R. with a severe brain injury, encephalopathy, cortical vision impairment, truncal hypotonia (low muscle tone), and kidney failure.
After months of treatment at the hospital, baby O.R. finally went home, but her disabilities require specialized medical care and supervision around the clock for the rest of her life.
The $101 million-dollar settlement will pay for the child’s constant high-level medical care for the rest of her life. The family received a lump sum of $1 million dollars to cover the immediate costs of medical bills and expenses. The rest will be paid out through an annuity over the child’s lifetime.
Some vaccines can be useful, but they are risks everyone should be aware. Vaccines aren't purely safe across the board, not safe for everyone. It's been shown in a DOJ Vaccine Injuries and Death report that there are injuries and deaths from vaccines. Yet, despite those facts, the media and public will say otherwise, often castigating those who say otherwise, declaring them to be uneducated quacks, and that goes for doctors who aren't toeing the polarized belief that all vaccines are 100% safe for everyone.
In the US, people can't sue the vaccine manufacturers direction since the 1986 National Vaccine Injury Compensation Program (NVICP) is there to buffer and protect the vaccine makers from being sued directly. People can sue the government who will then determine if they get compensated for a vaccine injury claim.
Vaccines are unsafe, and people should know about it instead of being told there is nothing to worry about. When some parents learn about the risks and danger, it's often too late. Doctors aren't helping families be protected, as their is a concerted effort to shove vaccines down our throats, especially onto the most helpless of all: children. California has mandatory vaccination laws, for instance. Doctors who want to exempt child patients for medical reasons are treated as if they're medically incompetent and put on probation.
After the so-called "measles outbreak" at Disneyland, California in 2015, there was a media blitz to push for MMR vaccination, and people bought into it. No one died from the measles in the outbreak, or in the past 10 years, but people have been severely injured and died from the vaccine. Which is a greater risk?
Does that matter when there are huge profits to be made, and big pharma pushes for lobbying in government, medicine and the media to favorably present the vaccine? Take a look at the Bloomberg chart to see how fear of the measles drove the Merck production of sale of the MMR vaccine:
Two former employees for Merck filed a lawsuit against the company. Stephen Krahling and Joan Wlochowski, former Merck virologists, claimed they "witnessed firsthand the improper testing and data falsification in which Merck engaged to artificially inflate the (MMR) vaccine's efficacy findings." This faulty vaccine has resulted in vaccin einjuries, and lawsuits that cost the US "hundreds of millions of dollars for a vaccine that does not provide adequate immunization".
As the largest single purchaser of childhood vaccines (accounting for more than 50 percent of all vaccine purchases), the United States is by far the largest financial victim of Merck’s fraud,” according to the 2010 False Claims Act complaint.“But the ultimate victims here are the millions of children who every year are being injected with a mumps vaccine that is not providing them with an adequate level of protection.
And while this is a disease that, according to the Centers for Disease Control (‘CDC’), was supposed to be eradicated by now, the failure in Merck’s vaccine has allowed this disease to linger, with significant outbreaks continuing to occur. (Source)
Merck has bee fighting this lawsuit for 8 years, but can't get it squashed and hidden from the public, at least not yet. A 2012 motion to dismiss the case was denied. There are 165 court docket entries for this case during the past 8 years, showing how much Merck lawyers are trying their best to get rid of it.
Hopefully the former Merck virologists win their case, setting a precedent, and show that Merck made an ineffective, and even dangerous vaccine that does more harm than good. It might be too late for the baby girl who won the lawsuit above, but further children can be spared such suffering and ruin to their lives.
