First off, the right to refund is a consumer protection right, according to German distance marketing and selling laws, considering §§ 312d, 312b, 312c, 312e BGB and/or the so called distance selling directive 97/7/EG of 20th May 1997. There has been a judgement about this. The Judgement ID is: 16.12.2011, Az. 14 O 27/11 KFH III. This judgement also points out to the "Information duties and following duties" are also a part of the consumer protection right. Since June 2014 it also is an absolutely mandatory part of the distance selling directive and especially the "information duties and following duties", that the customer has to be informed and has to approve the recognition of the loss of his right of refund. For example in shape of a checkbox at the very bottom of the approval that you have to fill in like for the policies.
