it is very loud, it makes you jump. I think Orca know this too, which at times they like to sneak up on you on purpose and exhale in order to make you jump. Just part of their cheeky nature.

no, you are not allowed to approach within 5 metres to a penguin. However, most of the time if you are patient and just sit there and wait, they themselves will become curious and approach you. patience
